| PROPERTIES IN FRANCE – LANGUAGE BARRIERS | | Buying properties in France, as with a British property purchase, involves reading a lot of complex documents. There is the agents description, technical property reports, environmental and building surveys, the pre-sale document or 'compromis de vente', power of attorney and the final sales act to name a few.
This can prove very tricky if you do not speak French.
One option is to employ the services of a qualified translator, indeed some documents require an approved translator for documents for use in court for example. These translators can be expensive so you could consider one that provides a literal translation. However, elements can get lost in translation and the original French language document will always stand up in court.
The differences between French and British law mean an English translation can still be difficult to understand.
Another option when buying properties in France is to hire an interpreter who can be present at the signing of principle documents. Ensure this person has a good grasp f both English and French property law and knows the local area as nuances in the law often occur across regions.
Notaire’s are under no obligation to ensure you fully understand the documents for purchasing properties in France so an interpreter can provide welcome comfort in these situations.
It is reassuring to know, however, that most of the documents associated with buying properties in France are pretty much standard for example the ones governed by FNAIM, the French Estate Agents Federation. A family lawyer, even one with a good grasp of the French language and laws, can still only review the documents based on the original documents supplied, and should be no substitute for local knowledge.
